WILLIAMS – PROPERTY WITHDRAWAL REQUEST (NG-33C) 4-7-2016

I am emailing the entire GLA board a copy of my original letter which I sent via US Mail on April 5, 2016 to the attention of Charlotte Mizzi, president of the GLA.  This is intended to assure that ALL board members see our letter, not just a selected few.

Dear President Mizzi:

My wife and I are writing the GLA board of directors to request that the Glastonbury Landowners Association agree to the withdrawal of our real property (NG-33C) from the Association.  Section 1.04 of the Restated Declaration of Covenants for the Community of Glastonbury states, in relevant part:

Property Withdrawn from Declaration.  The Association shall have the right at its option and at any time in the future to withdraw any property from the covenants in this Declaration, by executing and recording an instrument in writing describing any property owned by the Association to be withdrawn, or by executing and recording a written agreement between the Association and the owner(s) describing the property to be withdrawn from the covenants.

We desire to enter into an agreement with the Association to withdraw our property from the Association as referenced above.  We are agreeable to a proration of the annual assessment to cover our pro rata share of road maintenance fees, but otherwise desire to be relieved of any further obligations or restrictions, save the existing easements or rights of way in effect at the time of the agreement.

Please advise us as to your position on this request within 30 days, or sooner, or we will advise our attorney to proceed with legal recourse.  We hope to be able to resolve this issue and accomplish our objective without resorting to legal action.  Please take this matter seriously.  As the board has been regularly ignoring landowner communications and requests, we are making this a “Formal Complaint,” accompanied by the official Formal Complaint Form which requires action by the board “in a timely manner.”  Note that my Formal Complaint to the board dated January 17, 2016 has never been acknowledged or addressed.

If the Association is agreeable to granting our request we will have our attorney draft the Agreement in accordance with the Covenants, thus sparing the Association any legal expense.
